Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the Appfunnel platform at appfunnel.net and any related services (the "Service") provided by Appfunnel, a company registered in Denmark ("we", "us", "our").

By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. The Service

Appfunnel is a web-based platform that allows you to build, publish, and manage sales funnels, checkout flows, quizzes, and paywalls with integrated payment processing and analytics. The Service includes the funnel editor, analytics dashboard, customer management, integrations, and all related tools.

3. Account

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account.

You may invite team members to your project. You are responsible for their actions within your project and for ensuring they comply with these Terms.

4. Billing & Payments

Access to the Service requires a paid subscription. Subscriptions are billed through Stripe on either an invoiced or usage-based basis, depending on your plan.

All fees are stated exclusive of applicable taxes. You are responsible for any taxes that apply to your payments.

We may change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Payment Processing for Your Funnels

The Service allows you to connect your own Stripe or Paddle account to accept payments from your end users. Appfunnel is not a party to these transactions. You are solely responsible for:

  • Compliance with the terms of your payment provider (Stripe, Paddle)
  • Refunds, disputes, and chargebacks
  • Tax collection and reporting for your transactions
  • Providing accurate product descriptions and pricing to your end users

6. Your Content

You retain ownership of all content you create or upload through the Service (funnels, images, text, videos, etc.). By using the Service you grant us a limited license to host, display, and distribute your content solely as necessary to operate the Service.

You are responsible for ensuring your content does not violate any applicable laws or third-party rights.

7. End-User Data

When you publish funnels that collect data from end users, you are the data controller for that data. You must:

  • Have a lawful basis for collecting and processing end-user data
  • Provide your own privacy policy to your end users
  • Comply with all applicable data protection laws (including GDPR if your end users are in the EU)
  • Not collect sensitive personal data without appropriate safeguards

Appfunnel acts as a data processor for end-user data collected through your funnels and will process it only according to your instructions and as described in our Privacy Policy.

8. Custom Code

The Service allows you to add custom JavaScript to your funnels. You are solely responsible for any custom code you add and its effects, including any additional data collection it performs. Custom code must not be used for malicious purposes, including but not limited to malware distribution, phishing, or unauthorized data collection.

9. Prohibited Use

You may not use the Service to:

  • Violate any applicable law or regulation
  • Infringe on intellectual property rights of others
  • Distribute malware, spam, or phishing content
  • Sell illegal products or services
  • Engage in fraudulent or deceptive practices
  • Interfere with or disrupt the Service or its infrastructure
  • Resell or redistribute the Service without our written consent
  • Attempt to reverse-engineer or extract source code from the Service

10. Integrations

The Service allows you to connect third-party services (Stripe, Paddle, Google Analytics, Meta Ads, webhooks, etc.). These integrations are governed by the respective third party's terms. We are not responsible for the availability, accuracy, or conduct of any third-party service.

11. Availability & Support

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability. We will make reasonable efforts to notify you in advance of planned downtime.

12. Limitation of Liability

To the maximum extent permitted by law, Appfunnel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, profit, data, or business opportunities, arising from your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

14. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days of account deletion, except where retention is required by law.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of Denmark. Any disputes shall be resolved in the courts of Denmark.
